戦後日本の最高裁判例のうち、読み応えのあるものを選んで、判例の読み方を訓練することを目的とする。

国家とは住民から税金を徴収し、経済活動を規制し、様々な行政サービスを提供する組織である。近代社会の最も重要な特徴の一つは、この巨大な権力を持つ組織が出現し、その権力が生活の隅々へと浸透したことにあった。民主主義体制であるか、権威主義体制であるかに関わりなく、今日ではあらゆる人々が国家の権力の下で暮らしている。それでは、国家はいかにして、人々を支配するようになったのだろうか。 これは、国家論に関わる問題である。本演習では、この問題に取り組むべく、マックス・ウェーバーの２つの著作を輪読する。ウェーバーの構築した精緻な体系と、その背後にある西洋社会の歴史的な文脈を理解することは、それとは全く異なる歴史的文脈の下で西洋流の統治のモデルを輸入した日本における行政のあり方について考える上でも役立つだろう。 だが何よりも、ウェーバーは面白い。まずは、社会科学の第一級の古典とされる作品に、思い切って触れてみようではないか。

法学を必ずしも専攻しない学生も対象に、「日本国憲法」の基本的原理を、その歴史的背景にも配慮しつつ講義する。

　今回の授業では、「新自由主義」という社会モデルに注目し、その理論的射程、妥当性、教育研究との接合可能性について、関連する文献・論文を読み議論を通じて検討する。テーマの背景は以下の通りである。 　19世紀の批判理論の課題が貧困だったとしたら、20世紀後半までのそれは管理国家／社会だった。戦後の進歩的な教育学もその社会像を敵手として、子どもの自発性・主体性、水平的なネットワーク、参加や多様性の促進などを変革の賭金と見なしてきた。 　その構図が反転したのが新自由主義という社会モデルだった。それは、社会・国家の諸領域を市場のルールのもとで強権的に再編する統治性とされ、管理的な福祉国家体制（公教育も含む）を縮小・解体するために、柔軟性や自発性を活用・動員するとされた。その中で、安易な形で主体性や選択肢・多様性の増大を称揚することは、良くてお花畑、場合によっては統治の強化と共振する利敵行為とみなされるようになる。リベラルの言説磁場は大きく変動した。 　この構図は2000年代以降の教育研究にも大きな影響を与えた。日本のアカデミズムの中で、新自由主義の概念を最も用いてきたのは、実は教育研究の領域だった。教育格差・子どもの貧困の拡大、教員の労働環境の悪化、大学への統制強化など様々なイシューが「新自由主義」という概念の下で捉えられ、実証研究／思想研究／実践の枠を越えた連携が緩く築かれた。 　その構図は再度揺らいでいる。日本では2010年代半ばから大規模な財政出動・金融緩和が顕著になる中で――緊縮に苦しむ欧州では再注目されるようになったのとは逆に――新自由主義概念はオワコン化したと喧伝されるようになった。現在は世界に目を向けると、自集団の利益のために市場的理性すら恣意的に歪める一方、多様性に対して攻撃する政治が前景化している。これは「資本の論理」の徹底にも見えるが、経済的にも文化的に「自由主義」からすら離れていく側面を持つ点では、新たなフェイズかもしれない。 　このように「新自由主義」概念との距離が意識されるようになり、様々な議論が出揃った現在こそ、本概念の性能について冷静に吟味する好機だと考えられる。この概念はいかなる社会の観察のもとにリアリティを獲得し、認識利得はどこにあったのか。教育研究はその概念のもとで何を明らかにし不可視化してきたのか。我々は今後いかなるモデルの下で社会を捉えていくことができるのか。これらの問いについて様々な角度から検討していきたい。 　なお受講の上で専門的な知識は必要ありません。今はどういう時代なんだろう？という疑問があれば十分です。

This course explores the visions and historical processes that shaped the political, economic, and legal principles, policies, and practices of a transnational order in East Asia from the mid-nineteenth century to the mid-twentieth. Its focus will be on the trans-Pacific interactions between the United States, Japan, the Philippines, and China, but always with the rest of East Asia in mind. The discussions will delve into the interplay of law, politics, and economics during the period covered. Through these discussions, this class will explore new ways of understanding the historical developments whereby a coherent transnational order was formed in East Asia. The aim will be to overcome the limitations of the two prevalent narratives regarding East Asian history. The first, known as the “Western Impact” model, looks at modern East Asian history in the context of how each society reacted to Western powers attempting to dominate the area through trade and colonization. The second approach has traditionally been presented as an antithesis to the first, focusing on the internal logic of East Asian societies, and modernization in these societies is explained by referring primarily to domestic political dynamics, avoiding overemphasis on influence from the West. By grounding our analyses on the development of a transnational order among East Asian societies on one hand, but focusing on trans-Pacific interactions on the other, our objective will be to re-assess not just the history of East Asian societies, but the history of the US, and its role in the shaping of a global order that remains crucially important to this day.

新興都市の急速で圧縮した発展の原動力、メカニズム、課題について検討する。アジアの新興都市の経済・社会構造の特徴と変容を理論的・実証的に理解する。 The course provides explanation of driving forces of rapid and compressed development of emerging cities, its mechanism and challenges. It aims to provide theoretical and empirical understanding of economic and social structures and their transformation of Asian cities.
