Michel Troper, La séparation des pouvoirs et l’histoire constitutionnelle française, LGDJ, 1980を読む。著者は，フランスを代表する憲法学者・法哲学者であり，憲法史に関する著作も多い。本書は，彼の博士論文であり，権力分立についての古典と考えられている。権力分立についての通念を打破した作品であるが，彼が積極的に何を論じたのかは，日本では思いのほか知られていない印象がある。また，憲法（史の）重要な論点を調査・検討していくその思索の過程は，研究者としても勉強になる。文章は凝縮されており（全体でも本文208頁），精読にも向いていると思われる。
本年度は，第1部後半を採り上げる予定である。扱われる具体的な主題は，立法者照会（法律の解釈），大臣責任である。いずれも広がりのある主題である。

サイバー空間とデジタル空間が高度に融合するデジタル社会においては、AI・データやこれらを使ったデジタルシステムを連携する基盤において様々なサービスや規制が展開する。そのような社会において生じる様々な課題を解決するための新たなガバナンスモデルである「アジャイル・ガバナンス」は、政府のデジタル原則にも取り入られており、また、国際的な場でも議論され、今後の法や規制のあり方に大きな変革をもたらすことが予想される。本演習では、このような現在進行形で議論されている問題状況について、法学の観点から理解を深めるとともに、生成系AIや自動走行、デモクラシーなどの様々な課題について、実践的な検討を行うことにする。

比較的近時に現れた最高裁判例の中には、従来の学説において必ずしも自覚的に論じられてはこなかった新たな問題を含んでいる興味深いものがみられます。本演習では、そのような民法に関する新たな課題に焦点を当てて判例を分析し、それが既存の議論の枠組みにどのようなインパクトを与えるものであるか、検討することを通じて、民法についての基本的な理解を深めるとともに、新たな問題をみずから分析する能力を修得することを目的とします。
さらに、演習に参加することは、単に大教室で一方的に講義を受けるだけでは得ることのできない、法学部図書室やインターネットを利用して判例や文献等を自分で検索することや、課題を分析検討した結果を一定の視角から論理的に構成してわかりやすくプレゼンテーションすること、といった法律学を学ぶ者としての基礎的な素養を習得することも目的としています。
