Environmental Management and Policy IV

Law and Natural Resources
This course addresses the role of law in regulating natural resource exploration, exploitation and conservation either within or beyond national jurisdiction. It focuses on specific materials and processes that exist in nature and are considered of actual or potential use or value to humans : land, minerals, genetic resources, Antarctica, and so
forth. Through an integrated analysis of seemingly disparate fields of law (environmental law, investment law, human rights law, socio-legal studies), students explore how the law mediates the competing interests that come into contact as a result of economic globalization. Using case studies and joint mini-projects, they discuss this complex, ever-evolving and uneven web of legal norms from the critical perspective. In so doing, they both assess to what extent and with what consequences law is forged by an anthropocentric view of nature; and examine the opportunities and constraints for different (legal) approaches.

WEEK 1 - Introductory lecture and guidance: basic notions, terminology, course plan, learning methods, readings and other sources’ overview WEEKS 2/3 - Natural resource and law in a globalized world: Conceptual framework (Interactive lectures + group and classroom discussions based on pre-assigned readings) WEEKS 4/5/6/7 - Resources under national jurisdiction (Interactive lectures + group and classroom discussions based on pre-assigned readings + case studies) W4: Biological resources and law: focus on land and forests W5/6: Energy and law: focus on oil and gas W7: Other resources: focus on water and minerals WEEKS 8/9/10/11 - Resources beyond national jurisdiction (Interactive lectures + group and classroom discussions based on pre-assigned readings + case studies) W8: High seas fisheries and law W9: Resources of the International Seabed Area W10: Marine genetic resources of areas beyond national jurisdiction W11: Antarctica resources and legal regimes WEEKS 12/13 - Preparation and presentation of a joint mini-project
授業の方法
Classes consist of interactive lectures, followed by both group and classroom discussions addressing broad concepts or focusing on case studies. These discussions are generally based on pre-assigned readings and build on a list of questions proposed in advance. Students will also prepare and present a joint mini-project (final team-based assignment).
成績評価方法
1) Active participation to group and classroom discussions : 25%. 2) Individual write-ups (submission of four to five 500-word write-ups) : 40%. 3) Preparation and final presentation of a joint mini-project : 35%. Any change that might be needed in the assessment for the course due to the situation as a result of the Covid-19 virus will be communicated in due course.

履修上の注意
No prior study of law and policy is required, but a strong interest and a serious commitment to learning about environmental issues from a cross-disciplinary perspective is essential. This class is partly conducted in the active learning style, and constructive participation by students is highly encouraged.
