Special Lecture on Global Society III

Earth System Law and Governance
Are law and legal science in their present guise suitable to navigate the Anthropocene? Addressing the need to critically revisit the place, role and purpose of law in contemporary society, this course explores the possible development of innovative legal responses to the many complex, multi-scalar governance challenges arising from within an Earth System context. Through short interactive lectures, classroom discussions based on pre-assigned readings and case studies, students examine the transformative potential of Earth System Law and Governance and discuss the promise of this emergent alternative conceptual framework to evolve from a theoretically innovative perspective to facilitating positive, on-the-ground change.

WEEK 1 - Revisiting the place, role and purpose of law in contemporary society: Introductory lecture and guidance (basic notions, terminology, course plan, learning methods, readings and other resources’ overview) WEEKS 2 to 6 - The Earth System Law paradigm (Interactive lectures + group and classroom discussions based upon pre-assigned readings) W2: Law and the Anthropocene ‘brave new dystopian world’ W3/4: The emerging paradigm of Earth System Law and its transformative potential W5/6: Earth System Law and the Earth System Governance (ESG) Project WEEKS 7 to 11 - The challenges of translating Earth System Law and Governance from theory to practice (Short interactive lectures + group and classroom discussions based upon pre-assigned readings + case studies) W7: Architecture and agency (theme 1) W8: Democracy and power (theme 2) W9: Justice and allocation (theme 3) W10: Adaptiveness and reflexivity (theme 4) W11: Anticipation and imagination (theme 5) WEEKS 12/13 - Navigating the Anthropocene: Legal perspectives (Preparation and presentation of a mini-project)
授業の方法
Classes typically consist of short interactive lectures, followed by both group and classroom discussions addressing broad concepts (weeks 1 to 6) and/or focusing on contextualised issues (weeks 7 to 13). These discussions are based on pre-assigned readings and other materials, and build on a list of questions proposed in advance. Classes also include specific learning activities conducted on either an individual or a collaborative basis (case studies). Sessions 12 and 13 consist of the preparation and presentation of a joint mini-project (team-based final assignment).
成績評価方法
1)Active participation in group and classroom discussions : 20%. 2)Individual write-ups (submission of a total of four 700-900 word write-ups) : 40%. 3)Mini-project (final assignment) consisting of one joint oral presentation (on WEEK 13) and one individual 1000-1200 word write-up (submitted after WEEK 13): 40%.

No reference book. Bibliographical references will be provided throughout the course.
履修上の注意
No prior study of law and policy is required, but a strong interest and a serious commitment to learning about environmental issues from a cross-disciplinary perspective is essential. This class is partly conducted in the active learning style, and constructive participation by students is highly encouraged. Class material and regular updates available on Google Classroom. Please self-enroll on ITC-LMS, then register on Google Classroom.
