演習(Big Tech and the Law)

Big Tech companies such as Google, Amazon, Meta, Apple and Microsoft play an important role in the digital economy and in our daily lives. They have transformed how we shop, search and communicate and few of us would want to give up the convenience they bring. Yet the rapid growth and enormous power of these companies have also raised serious concerns. Have these companies become digital monopolies? Have they abused their market power to exclude smaller competitors? Have they become so large that they can no longer be regulated? Do they pose risks to democracy and other public values?

This course examines these questions primarily through the lens of competition law, while also paying close attention to other key areas of digital regulation. Big Tech is a natural subject for transnational legal analysis because these firms operate across borders in ways that no single legal order can fully capture. The main focus of the course will be on the approach in the EU, Japan and the U.S., and how these regimes interact, but developments in other jurisdictions may be discussed where relevant.

By the end of the course, students should be able to:
•Understand the main legal problems raised by Big Tech.
•Explain the legal tools used to address these problems.
•Describe and compare how the EU, Japan and the U.S. regulate Big Tech.

Class schedule (subject to change): Class 1: Introduction Class 2: Getting to know Big Tech: which companies and what is their business model? Class 3: Basics of competition law Class 4: Key cases brought against Big Tech 1 Class 5: Key cases brought against Big Tech 2 Class 6: Key cases brought against Big Tech 3 Class 7: Key cases brought against Big Tech 4 Class 8: The EU’s Digital Markets Act Class 9: Japan’s Mobile Software Competition Act (スマホ新法) Class 10: The EU’s Digital Services Act Class 11: Key cases brought against Big Tech 5 Class 12: Key cases brought against Big Tech 6 Class 13: Other fields of law and Big Tech (AI regulation, privacy, etc.)
授業の方法
Mix of: - lectures with concrete examples, - student presentations, and - class discussion of real cases. Students will be asked to give short presentations on topics relevant to the class.
成績評価方法
Pass or fail. 合格・不合格 Students will be evaluated based on class participation (授業参加・発言), meaning (1) their contribution to the class discussion, and (2) the quality of their short presentations in class. There is no report or final exam.
履修上の注意
This seminar is an exception to the "one seminar per semester rule", meaning you can take this seminar and still take another seminar. 1学期1演習の例外適用 No prior knowledge of competition law or digital regulation is required. The seminar will be taught as an intensive course in December. To avoid conflicts with other courses, the classes will take place at times when there are no other courses, such as Thursday afternoons, Friday afternoons, and a single Saturday and Sunday.
