Negotiation Workshop: Theory, Skills & Practice

WHY LEARN NEGOTIATION? Negotiation skills are integral to legal careers – whether in government, the legal professions or business. More fundamentally, they are essential for navigating an increasingly complex world, in a wide range of contexts, from the personal to the political. This workshop-style course teaches Harvard-style negotiation theory, which is also described as ‘win-win’ negotiation. Students then add and polish key practical skills, before applying this new knowledge across a sustained series of role-playing exercises.
LEARNING OUTCOMES
We will spend 10 of our 13 weeks doing negotiation exercises.
In each of these weeks, we will take time for reflective practice, to reinforce individual learning.
This reflective practice will include self-evaluation, peer evaluation and instructor feedback.
And students will submit a final report that reviews their own learning experience over the semester as a whole.
This pattern of reflection will allow each student to:
- identify their own negotiating style, strengths and weaknesses; and
- assess how they might enhance their skills.
Students who take similar courses in legal education programs around the world often see the experience as a highlight of their university career.
In addition, they find that it pays good dividends in their working and personal lives.

WORKSHOP DESIGN Students will work within small, diverse teams to resolve a series of real-world disputes through negotiations with similarly diverse counterparty teams. This approach models Japan’s changing workforce and prepares students for the globally dispersed teams and cross-border projects that characterize many legal careers. The course embraces both the rich potential and the risk of discomfort that characterize teams made up of people with different demographic attributes. SYLLABUS The course will be divided as follows: * Week 1 ~ Week 3: Negotiation theory * Week 4 ~ Week 9: Skill-building negotiation exercises * Week 10 ~ Week 12: Capstone multi-week multi-party negotiation exercise * Week 13: Reflection MODE While the classes will be held in person as a rule, we will leverage hybrid and online modes as needed. STUDENT WORKLOAD There will be pre-readings for the first three weeks then students will be expected to work in teams outside class to prepare for each negotiation exercise. That said, all weekly negotiation exercises will be manageable in terms of length and complexity. This will ensure that the time needed to prepare outside class will be reasonable and sustainable. Each team will have internal autonomy as to how the work of preparing for a negotiation is done and how speaking roles are allocated each week. However, all students will be expected to contribute in roughly equal shares to preparatory work and every student will lead a negotiation for their team - at least twice.
授業の方法
Students will experience three weeks of theory and ten weeks of negotiation practice. The negotiation exercise scenarios will ask students to take on several different roles – including as legal professionals, business executives, civil society actors and government officials.
成績評価方法
Active class participation will count for 60% of the grade. A final reflective report will count for the other 40% of the grade. There will be no examination. Grading will be in accordance with the A・B・C・F grading scale.
履修上の注意
No prior knowledge of negotiation is required. Students must have a good command of spoken English.
