法のパースペクティブ:Outsiders and Criminal Justice in Japan

Outsiders in Japan's Criminal Justice System
In this interactive course we will introduce a socio-legal approach to Japan's criminal justice system and discuss its changing socio-political context by paying attention (using methods from the field of sociology of law) to a diverse group of "outsiders" (= professionals other than lawyers, prosecutors or judges or citizens) in Japan's criminal justice system who work alongside judges, prosecutors and lawyers with suspects, defendants and/or (ex-)convicts (= 加害者の視点). Particular attention will be given to recent challenges faced by forensic psychiatrists, social workers, forensic scientists and lay judges in novel approaches such as "therapeutic justice" (治療的司法) or "holistic justice" (包括的司法), which aim to change the traditional way of approaching the criminal justice system. We will also look at issues related to the path to these changes (= the issue related to the reform of the justice system and its institution) - history matters and focuses on its content before turning to how these non-professionals of law operate in reality.

In this course we will depart from the articles in a recent special issue (特集) of the journal 法律時報(2024年3月号) in combination with Erik Herber's award-winning book 'Law and Expert Contributions to Japanese Criminal Justice' (Routledge, 2019). Readings in English and Japanese will provide a springboard for discussion, and guest speakers (in Japanese and English) will also help answer the key questions: What are the weaknesses and strengths of the Japanese criminal justice system? What are the remedies for the weaknesses? What is the purpose of criminal law and procedure, and how can we understand the gap between theory and practice? Many of the insights offered in this course will be based on disciplines other than black letter law, such as sociology, history and comparative politics.

The main aims of the course are, firstly, to broaden the student's view of the changing role of law in society, secondly, to become familiar with the methodologies of socio-legal studies and, thirdly, to express and understand opinions and insights in English in a critical and constructive manner.
