English Contract Law

English Contract Law
This course investigates the law of contract in common law jurisdictions, with a particular focus on the law of England. Students will learn to think critically about issues of contract law theory and practice. We consider the differences (real or imagined) between common law contracts and the contract law of Civilian jurisdictions, and assess the strengths and shortcomings of the English law position. Using untranslated primary sources (principally case law from the courts of England & Wales), students come to understand the common law of contract, its history and its continuing development.
