英米法総論

Common Law Fundamentals and Contemporary Topics
We will study the historical development and fundamental principles of the common law tradition, focusing on English and American law but also comparing aspects of Asia-Pacific common law legal systems (in Southeast Asia, India, Canada, Australia and New Zealand). We will introduce institutional features differing from Japan, including the legal profession and education, judicial procedures and federalism, while examining specific fields such as contract law, tort law, consumer law, corporate governance, civil procedure, Alternative Dispute Resolution (ADR), criminal procedure, civil rights and fundamental constitutional principles. (My separate course “Contemporary Anglo-American Law 2” looks in more detail at Dispute Resolution in Common Law Asia.)
