Introduction to Japanese Law

Introduction to Japanese Law
This course will help students understand the fundamentals of law in contemporary Japan.
Students will gain a foundational grasp of the origins of Japan’s legal system and the key concepts and influences that shape it today, both in isolation and in their social context.
Students will learn to consider core areas of Japanese law critically, discuss their perspectives with others, and draw on comparisons with other legal systems as needed.
The course assumes no knowledge of Japanese law or law in general.

1. Introduction and the 'rule of law' 2. 'Civil law' vs 'common law' legal systems 3. Japan’s legal history 4. Sources of law in Japan +++++ 5. Legal actors:attorneys 6. Legal actors: judges 7. Contracts: making and breaking agreements 8. Litigation: litigiousness and 'cause lawyering' 9. Criminal justice: policing and prosecution 10. Criminal justice: participation, prisons and probation 11. Employment law: work-life balance and equal employment opportunity +++++ 12. The 1946 Constitution: imposed or embraced? 13. Contemporary constitutionalism: gender, the family and sexuality
授業の方法
The class will be interactive, mixing lecture-style content with class discussion on the reading materials assigned for each week. Each student will give one in-class presentation between Week 5 and Week 13.
成績評価方法
30% Class participation (including in-class presentation) 20% Short report - due mid-December 50% Long report - due in January Whether a student has graduated from another degree is taken into account when evaluating grades.

Reference materials will be provided via UTOL as needed.
履修上の注意
The course will be conducted entirely in English. A good level of spoken and written English is required to perform well.
