地中海古典テクスト分析演習III

　紀元６世紀の東ローマ皇帝ユスティニアヌスが編纂させた『法学提要Institutiones』第３巻のラテン語テキストを輪読する。読解を通じて古代ローマ法に関する基礎的な知識を獲得するとともに、古典期法学者の著作との比較を通じて、時代の要請に応じて法原則が修正されていった歴史的過程を探ることを目指す。また、一次史料や二次文献を利用する上での作法についても適宜指導する。
　今セメスターで扱う第３巻は無遺言相続（死亡者が遺言を残さなかった場合の財産の移転）に関して論じた後、様々な債権債務関係に関する規定（物の貸し借りや損害賠償など多岐にわたる）を扱っている。一見すると少し近づきがたいテーマに見えるかもしれないが、ローマ社会でのモノを介した様々な人間関係を理解することができるほか、奴隷と主人の関係をはじめ家族関係を理解する上での手掛かりが随所にちりばめられている。このようなテキストを読むことで、法学に関する専門知識を得るだけでなく、当時の人々の暮らしや社会状況の歴史的変化をテキストから読み解くことを目指す。
　なお、授業では、ラテン語の精読に重きを置く。履修学生の理解度に応じて文法事項の確認も適宜行いながら進めていくことで、ラテン語の基礎的読解力を高めることも目指す。
The main objective of the seminar is to enable students to develop the basic ability to use historical sources for the classical and Byzantine studies. In this seminar, the book 3 of Institutes of Justinian, the Eastern Roman Emperor (527-565), will be read. Institutes was made as a primer for students of legal studies, and has left an enormous impact on the development of later legal history, including Japanese civil law.
Reading the original text attentively will deepen the knowledge on the ancient world and help students to acquire practical skills of using historical sources. Some command of Latin reading is necessary for the participation in class. It is recommended to have some knowledge on the grammar of Latin.
