イタリア地中海歴史社会論I

古代ローマの家というと、家父長制だ、男性中心主義だ、奴隷制社会だ、と批判的な目で見られるかもしれない。確かにローマ法には、家長の権力のあり方などに男性を基本軸にして設計したところが見られる。しかし、そもそもそのようなローマ法を発展させたローマ社会はどのような状況に置かれていたのか、また、女性たちはそのような社会でどのような暮らしを送っていたのかなど、社会実態を考えることも必要であろう。それは翻ってローマ法の影響を陰に陽に受けている近代法を考え直すきっかけにもなるはずである。この授業では、ユスティニアヌス帝によって作られた「ローマ法大全」の中の法学入門書である『法学提要』第2巻を日本語訳で実際に読み解いていき、古代ローマ法がどのようなものなのかを具体的に検討していく。また、それ以前に作られたガイウス『法学提要』との比較を通じて、ローマ社会がどのような変化を経験し、それに応じて法規則をどのように修正していったのか、また、そもそも帝国に生きる人々がどのような問題に直面していたのかを見ていくことを目的とする。
　内容面で少し重々しさを感じさせるかもしれないが、不明な点については教員からの解説を随時伴わせて、分かりやすさを重視して進める。要望があれば、随時授業内で意見してほしい。
The main objective of the class is to enable students to use historical sources for the Roman Law and to deepen their understanding on social life of the Roman Empire. In this class, the book two of Justinian's Institutes will be read. Institutes was made by Justinian, Emperor of the Eastern Roman Empire (527-565), as a primer for students of legal studies, and has left an enormous impact on the development of later legal system, including Japanese civil law.
Although the text itself is read in Japanese translation, reading the classical text attentively will deepen the knowledge on the ancient world and help students to acquire practical skills of using historical sources. Any command of Latin is not necessary for the participation in the class, although it is helpful. The whole teaching will be conducted in Japanese.
