民法演習（外国語科目）

契約に関する任意規定の意義をめぐる諸問題

　契約に関する法ルールは、当事者の合意によって変更・排除可能なルールとしての任意規定、および合意によっても変更・排除し得ない強行規定によって構成される。この任意規定の意義をめぐっては、近時、行動経済学の視点などを基礎として、契約当事者の選択をより良いものに誘導するための法的枠組みとして理論化を試みる動きなども活発になっており、学際的な議論の対象としても強い関心が向けられている。本演習では、契約に関する任意規定の意義をめぐる諸問題について主題的に扱う近時の書籍を取り上げて、検討を行うことを目的とする。以上の問題に関する検討を通じて、ヨーロッパにおける契約法をめぐる理論的潮流に接してみたい、といった学問的関心を有する学生の参加を歓迎する。

授業計画

　教材としては、Birke Häcker/Johannes Ungerer (eds.), Default Rules in Private Law (Hart Publishing 2025)、およびKaty Barnett/Jonathan Morgan/William Day/Andrew Robertson (eds.), Mandatory and Default Rules in Contract and Commercial Law (Hart Publishing 2026)を対象とし、それらに収録されている諸論文の中から適宜選択して読み進めることとする。　演習の進め方としては、各回における検討部分の概要についての報告者からの報告と、それに関する参加者全員での質疑応答を中心として、検討を行うこととする。　なお、参考までに、以上の教材のうちの前者（Birke Häcker/Johannes Ungerer (eds.), Default Rules in Private Law）の目次としては、以下のような章立てとなっている。 1.
