Digital Governance: How to redesign Technology, Law, and Market

The objective of this course is for students to learn variety of issues related with “governance” in the age of digitalization, and deliberate how to redesign technology, law and market to address them.
Our society is undergoing rapid and dynamic structural changes, thanks to cutting-edge technologies. Artificial intelligence (AI), Internet of Things (IoT), and 5G, through integrating both cyber and physical spaces, all combined have potential to facilitate economic growth, frame societal problems and consequently improve the quality of our lives.
To fulfill the potential, however, we face various “governance” issues to tackle with. For example, we may encounter privacy issues stemming from data collection through smartphones or sensors in public space. Cyber-attack could also do severe damage not only to physical and intangible assets but also to human lives, and even to function of democracy itself. The network effects along with small marginal cost would bring forth a “winner-take-all” effect in various markets. The unpredictable nature of AI poses questions on safety of, say, autonomous vehicles, and reliability of AI medical diagnosis.
Existing governance mechanism may not be well-suited for dealing with the issues mentioned above. Law no longer identifies the risks that should have been controlled for, as the technologies and business models shift too swiftly. The existing market rules fails to redress information asymmetry between digital platforms and users, and ensure free and fair competitive environments in digital space. The liability framework based on “predictability” malfunction with AI, which is presumably unpredictable by nature. To sum, cyber space has become too complex for us to get hold, as we have done in the physical space.
This course invites global experts and discusses how to redesign technology, law and market to realize Society5.0 by controlling emerging risks as well as maximizing innovation. Key concepts include (i) goal-based regulation, (ii) multi-stakeholder standard setting and review, (iii) compliance by design, (iv) real-time monitoring, (v) incentive-based sanction, and (vi) swift and effective dispute resolution. This course does not intend to provide solutions to each of the specific agenda, but rather to understand common characteristics and mutual connections among the topics, and ultimately help students to think on their own how to create a governance framework that can be applicable to various challenges arisen from future digitalization.
本講義の目的は、デジタル化の時代におけるガバナンスの課題について学び、その克服のために、技術や法、市場をどのようにデザインすべきかを検討することである。
AI、IoT、5Gなどの技術によって、我々の社会は、サイバー空間とフィジカル空間が融合するかつてない急速かつダイナミックな構造的変化を迎えている。こうした技術は、経済成長を加速すると共に、社会課題を解決し、我々の生活を一層便利で豊かにする可能性を含んでいる。
もっとも、そのような理想を実現するためには、様々なガバナンス上の課題を克服しなければならない。例えば、スマートフォンや公共の場におけるセンサー等によるデータ収集により、我々はこれまでにないプライバシーのリスクに直面している。サイバー攻撃は、データや物理的な資産だけでなく、人間の生命や民主主義システム自体にも危険を及ぼすものとなった。市場では、一部の巨大デジタルプラットフォームによる「勝者総獲り」の状況が生じている。動作を事前に予測できないAIを用いた自動運転車や医療画像診断システムについては、その安全性や信頼性をどのように確保するかが問題となる。
既存の法律市場ルールといったガバナンスシステムは、これらのリスクをコントロールしつつ、イノベーションを促進するのに最適であるとはいい難い。法は、急速に変化する技術やビジネスモデルに対して、「あるべき行為」を特定することの限界に直面している。市場では、デジタルプラットフォームとそのユーザーとの間の情報の非対称性が拡大した結果、公正な取引を実現するための環境整備が喫緊の課題となっている。予見可能性を前提とする責任分配のシステムは、性質上予見不可能であるAIについて十分に機能しないことが考えられる。そして何よりも、サイバー空間が複雑になりすぎ、外部からのみならず、システムを構築した技術者にとっても理解することが困難なものになってきている。
本講義では、こうした課題を克服し、Society5.0を実現するために、技術や法、市場をどのようにデザインすべきかを議論する。重要となるのは、政府のみならず、企業、個人、コミュニティも含めた、マルチステークホルダー型のガバナンスモデルである。たとえば、①ゴールベースの法規制、②マルチステークホルダーによる標準の設定とその見直し、③「バイ・デザイン」アプローチによる価値の実現、④リアルタイムモニタリング、⑤インセンティブベースの制裁メカニズム、⑥迅速かつ効果的な紛争解決といったアプローチが考えられるであろう。
本講義では、プライバシー、セイバーセキュリティ、公正競争、AIといった具体的なアジェンダを取り上げつつ、国内外の有識者を招いて、理論と実務の双方の観点から新たなガバナンスモデルの検討を行う。最終的な目的は、個々の論点に関する「正解」を見つけることではなく、受講者がこれらのアジェンダに共通する性質や相互の関連性を理解した上で、デジタル化によってもたらされる様々な課題に適用可能なガバナンスのモデルをデザインする力を身に着けることである。
