Law and/in the Anthropocene
This course explores how and the extent to which law is transforming in the Anthropocene. It examines the growing importance of critical approaches to environmental law and the progressive emergence of innovative regulatory frameworks in the face of ecological disaster. Through short interactive lectures, we will start by questioning the conception of the natural world on which Western Law has rested for centuries – that of an inert standing reserve of resources or a collection of passive entities dominated by physical laws and susceptible to appropriation by the sovereign subject. Then, based upon case studies and role-play simulations, we will investigate the role of nascent ‘more-than-human’ approaches to law in the design of new decision-making processes and governance tools (with a focus on ecosystem-based regulation, new forms of environmental stewardship and trusteeship, Nature’s rights and tribunals, as well as the criminalization of ecocide).

WEEK 1 - Introductory lecture and guidance: basic notions, terminology, course plan, learning methods, readings and other sources’ overview WEEK 2 - Law and the Anthropocene as a groundbreaking narrative (Introductory lecture + group and classroom discussions based on pre-assigned readings) WEEK 3 - Critical Environmental Law (CEL) and Earth system governance (Introductory lecture + group and classroom discussions based on pre-assigned readings) WEEKS 4/5 - Legal frameworks for ecosystem-based governance (Interactive short lectures + group and classroom discussions based on pre-assigned readings + case studies) WEEKS 6/7 - More-than-human approaches to law and the question of animals rights (Interactive short lectures + group and classroom discussions based on pre-assigned readings + case studies) WEEKS 8/9 - Can the courtroom save the planet? From climate change litigation to the criminalization of ecocide (Interactive short lectures + group and classroom discussions based on pre-assigned readings + legal cases analysis) WEEKS 10/11/12 - Ecological disasters and environmental law ‘in action’: from the global mercury crisis to fracking disasters and plastic oceans (Interactive short lectures + case studies + preparation of the final role-play simulation) WEEK 13 - Final role-play simulation
授業の方法
Classes consist of interactive lectures, followed by both group and classroom discussions. Generally based on pre-assigned readings, these discussions are student-led but teacher-channelled. Classes also include individual or joint oral presentations as well as specific learning activities conducted on a collaborative basis (teamwork), namely : case studies and role-play simulations.
成績評価方法
Evaluation is based on active participation to classroom discussions and learning activities as described above (60%). In addition, students are asked to write two short essays (mid-term and final) on issues discussed in the classroom (40%).

Will not use texbook. Most reading materials will be made available in class.
参考書
Will not use reference book. Reference books will be introduced throughout the course.
履修上の注意
No prior study of environmental regulation and policy is required, but a strong interest and a serious commitment to learning about environmental issues from an cross-disciplinary perspective is essential. This class is partly conducted in the active learning style, and constructive participation by students is highly encouraged.
