Competition law
This course will help students understand the fundamentals of competition law: the key concepts and rules, as well as the reasoning behind the rules.

We will do this by looking at competition law in three jurisdictions: the EU, Japan and the United States. Each of these jurisdictions has its own approach to competition law but there is a common core of fundamental principles.

The class is taught in English but students are free to ask questions or give comments in Japanese.

本講義は、競争法の基礎、すなわち主要な概念、ルールとその背景にある理論を理解することを目的とする。

本講義では、三地域(EU、日本、米国)における競争法を比較・検討する。それぞれ独自の特徴がある一方、基本となる原則には共通点もある。

授業は英語で行われるが、学生の質問及びコメントは日本語であっても歓迎する。

授業計画
The topics that will be covered include cartels, monopolization, vertical restraints, mergers and the enforcement of competition law. We will also examine some of the challenges competition law is facing. For instance, how should competition law deal with the new “digital monopolies” held by companies such as Amazon, Facebook and Google? What happens when competition law conflicts with other values, such as the protection of the environment or labour law? Competition law often relies on economic concepts. The course will also use those concepts so an interest in economics will be helpful. However, the economic concepts will be explained in class so no prior knowledge of economics is required. 講義では、カルテル、独占化行為、垂直的制限、企業結合や競争法のエンフォースメントを扱う。これに加え、競争法が直面しているいくつかの課題も検討する。例えば、競争法はAmazon、Facebook、Google等の企業が生み出した新しい「デジタル市場の独占」にどのように対処するべきか。競争法が環境保護や労働法など他の価値観と対立する場合はどうなるか、等である。 競争法は、しばしば経済学上の概念に依拠する。したがって経済学への関心が理解に役に立つ。ただし、これらの経済概念は講義中に説明するため、経済学に関する予備知識は必要ではない。
授業の方法
Lecture but with time for questions and discussion if students feel like it. 講義形式が基本であるが、必要に応じて質問及びディスカッションの時間もとる。
成績評価方法
Written exam + participation in class (small part of the grade). The questions on the exam will be in English but you can answer in either English or Japanese. Students will be asked to participate in some classes and based on their participation they can increase their final grade. 筆記試験を実施する。出題は英語で行うが、解答は英語・日本語どちらでもかまわない。授業中の発言が求めらることもある。授業中の発言が優れている場合、期末試験に加点される。
